Terms of Service

Markatit helps contractors create priced visual proposals and follow customer engagement. It does not replace the contractor's judgment, engineering, permitting, contract or construction obligations.

1. Agreement and business eligibility

Markatit is the operating name of this service. These Terms refer to its operator as “Markatit,” “we” or “us”; the name does not represent that a corporation or limited liability company has been formed. Operator and billing questions may be sent to support@markatit.com. The service is intended for United States business users.

These Terms govern access to Markatit. By creating an account, using the service or requesting a paid service, you agree to them on behalf of yourself and the business you represent. You must be at least 18 and authorized to bind that business. If you do not agree, do not use Markatit.

2. The service

Markatit provides customer and project records, contractor catalogs, preliminary pricing, property imagery, computer-assisted rendered concepts, branded quotes, share links, engagement events, follow-up tools and optional human assistance. Features and provider availability may change. A demo request is not a guaranteed appointment until Markatit confirms it.

3. Accounts and security

You are responsible for accurate account information, authorized team membership, credential security and activity under your account. Notify support@markatit.com promptly about suspected unauthorized use. Do not share private media URLs, session credentials or administrative access.

4. Customer data and source rights

You retain your rights in content you provide. You grant Markatit and its service providers a limited license to host, process, transform and display that content only to operate, secure and support the requested service. You represent that you have permission and a lawful basis to enter customer details, use property imagery, request derivative concepts and share the resulting proposal.

5. Visual concepts and simulated views

Rendered visuals are sales concepts, not surveys, measurements, engineering, architectural plans, permit documents or guarantees of buildability. Rendering systems may add, omit, distort or relocate property or product details. Ground perspectives reconstructed from aerial or 3D imagery are rendered concepts, not photographs. You must review every visual, price, scope, disclaimer and customer-facing link before sharing or relying on it.

6. Quotes and customer agreements

Markatit helps prepare and present preliminary quotes. The contractor—not Markatit—is the seller and is solely responsible for pricing, taxes, scope, terms, warranties, financing disclosures, licensing, permits, construction, customer consent and the enforceability of any agreement. A homeowner's click, like, question or “I'm interested” event is an engagement signal unless the contractor separately establishes a binding acceptance process.

7. Plans, billing and credits

Plan price, renewal period, included credits, trial terms and cancellation instructions must be shown before a charge. Subscriptions may renew until canceled when checkout is enabled. Usage is measured through an auditable credit ledger. Credits are service units, have no cash value, are not transferable and may expire or roll over only as the selected plan states.

Paid subscriptions renew for the disclosed billing period until canceled. You can manage cancellation through Settings → Billing → Manage billing, or contact support if you cannot access that option. Cancellation stops future renewals when processed before renewal; it does not by itself refund a paid period. Plan and seat changes take effect at the next monthly renewal, with no mid-cycle proration. A free workspace trial alone does not authorize a paid charge.

8. Payment finality and service-credit restoration

Payments for subscriptions, credit packs, add-ons and paid assistance are final and non-refundable except where applicable law or an express written commitment requires otherwise. We do not offer discretionary cash refunds for a change of mind, unused credits, lack of usage, partial billing periods or dissatisfaction with a concept that reflects the agreed service. This rule does not excuse failure to provide a legally required remedy.

Verified duplicate, erroneous or unauthorized charges will be corrected as appropriate. Required refund or cancellation rights and rights to raise a good-faith payment dispute are preserved. Earlier purchases remain subject to the terms and specific promises that applied when they were made; this policy does not retroactively remove those rights.

Failed renders and approved quality reviews restore eligible service credits under the Payment & Service Credit Policy. Those entries are not cash refunds and do not turn credits into redeemable money.

9. Human assistance

When you request assistance or refund review, you authorize the assigned staff member or qualified reviewer to access the selected task's project context. Human quote assistance costs $5 per request, paid separately from the subscription. Requested images and aerial captures use the organization’s credits. The customer reviews and sends the finished proposal. Delivery timing is agreed separately.

10. Acceptable use

You may not use Markatit to:

  • Break law, violate privacy or intellectual-property rights, deceive customers or impersonate another person.
  • Create sexual exploitation material, abusive content, unlawful discrimination or targeted harm.
  • Probe, bypass or disrupt access controls, rate limits, storage boundaries, share tokens or provider safeguards.
  • Upload malware, credentials, unnecessary highly sensitive data or content you lack authority to use.
  • Present a concept or simulated view as an actual photograph, engineered plan or guaranteed finished result.

11. Markatit intellectual property

Markatit owns the service, software, interface, documentation, templates and branding, excluding your content. Subject to these Terms, Markatit grants your business a limited, revocable, non-transferable right to use the service during an authorized account term.

12. Third-party services

Maps, imagery, rendering, hosting, storage, payment, email and other third-party services may have separate terms and availability. Markatit is not responsible for third-party outages or changes outside its reasonable control, but will not disclaim duties that applicable law does not permit it to disclaim.

13. Suspension and termination

Markatit may suspend access to protect customers, providers or the service; respond to nonpayment; investigate misuse; or comply with law. You may stop using the service and request account closure. Provisions that by nature should survive—including payment, IP, confidentiality, disclaimers, liability and disputes—survive termination.

14. Disclaimers

To the maximum extent permitted by law, Markatit is provided “as is” and “as available.” Markatit disclaims implied warranties of merchantability, fitness for a particular purpose and noninfringement. Markatit does not warrant uninterrupted operation, provider availability, perfect rendering accuracy, project feasibility, customer conversion or a specific business result.

15. Limitation of liability

To the maximum extent permitted by law, Markatit will not be liable for indirect, incidental, special, consequential, exemplary or lost-profit damages arising from use of the service. Subject to the exceptions below, Markatit's aggregate liability arising from the service will not exceed the amount your business paid Markatit during the 12 months before the event giving rise to the claim.

These exclusions and the cap apply only where enforceable. They do not exclude liability or remedies that cannot lawfully be limited, including applicable liability for fraud, intentional misconduct, gross negligence, personal injury or statutory consumer and privacy rights. Nothing promises immunity from a claim or substitutes for Markatit's own legal obligations.

16. Indemnity

You will defend and indemnify Markatit from third-party claims arising from your customer relationship, construction services, pricing, uploaded content, lack of permission, misuse of a concept, violation of these Terms or violation of law, except to the extent caused by Markatit's own unlawful conduct.

17. Texas law and courts

Texas law governs these Terms without regard to conflict-of-law rules. Any dispute not resolved informally will be brought in a state or federal court with jurisdiction in Texas. These Terms do not require arbitration or waive rights that cannot lawfully be waived.

18. Changes and contact

Markatit may update these Terms prospectively. Material changes will be posted with a new effective date and communicated when required. Contact support@markatit.com.
